Panjaya Acceptable Use Policy

This Acceptable Use Policy ("AUP") supplements the Panjaya Terms of Use (or any other agreement between you and Panjaya governing the use of the Service or Panjaya's other products and services) available at https://www.panjaya.ai/terms-of-use and applies to your access and use of the Service, Customer Content (including Input you provide to the Service and the Output generated by it), whether as part of the Website and Platform or your use outside of them. Capitalized but undefined terms used in the AUP have the meanings set forth in the Panjaya Terms of Use, or equivalent terms in any other agreement between you and Panjaya with respect to use of the Services.
You are prohibited from using the Service, Customer Content or Output to do or generate Output causing or which may cause any of the following (note that the below examples of prohibited conduct are not closed lists, and merely provided as examples):

  1. PROHIBITED ACTIVITIES
    1. Threats to minor safety and vulnerable groups
      • Generating sexualized or age-inappropriate content involving minors
      • Engaging in cyber-bullying;
      • Exploiting vulnerabilities of a specific group of persons based on their age, social, physical, or mental characteristics in order to materially distort the behavior of a person pertaining to that group in a manner that causes or is likely to cause that person or another person physical or psychological harm.
    2. Violate applicable laws
      • Violating the privacy rights, personality rights and intellectual property rights of others;
      • Generating defamatory Output;
      • Promotion of illegal activities such as real-money gambling, human trafficking and sex trafficking, illegal goods (such as arms) and dangerous and illegal substances and materials.
    3. Unapproved promotions
      • Promoting pharmaceutical and medical products and services, or engaging in or facilitating the use, acquisition, or exchange of regulated drugs or other controlled substances, without Panjaya's prior written consent;
      • Providing tailored professional advice including legal, accounting, financial, or health and medical advice to consumers or the general public without (i) a qualified professional in that field reviewing the Output before it is made available, and (ii) clear disclosure regarding the use and limitations of AI;
      • Promoting religion and religious activities without Panjaya's prior written consent.
    4. Fraud and deception
      • Using the Service or Output to defraud and deceive others;
      • Gaining unauthorized access to systems, information and locations (for example, the bank accounts of others);
      • Impersonating other persons without consent or legal right, or in a manner intended to deceive others about whether content was generated by AI;
      • Generating and distributing spam in violation of the CAN-SPAM Act of 2003 and other applicable laws;
      • Engaging in or facilitating unauthorized robocalling, call bombing or other forms of communications that may overwhelm or disrupt systems and their users;
      • Engaging in dark patterns, deceptive design, manipulative consent flows, or any practice intended to subvert user choice.
    5. Violation of political integrity
      • Generating and distributing Output which may adversely affect democratic processes, including misleading voters about their right to vote, time, place or voting eligibility requirements, impersonating political candidates for non-satirical purposes and spreading political misinformation and fake news;
      • Engaging in political advertisement and election campaigns without Panjaya's prior written consent;
    6. Harmful content
      • Generating and distributing Output containing or encouraging religious and political extremism, terrorism, racist or hateful speech;
      • Threatening, inciting or promoting violence against individuals or groups;
      • Harassing other persons;
      • Encouraging self-harm;

      For clarity, the prohibitions in this Section do not apply to activity in purely fictional contexts (e.g., violent speech by a character in a book, video game, or movie) or when it is part of reporting on newsworthy activity by third parties, as determined by Panjaya.

    7. Medical disinformation
      • Promoting the spread of medical disinformation, denying existence of health conditions or claiming or exaggerating health conditions or side effects that do not exist.
    8. Circumvention
      • Circumventing the technical and other safeguards set out by Panjaya or its Third Party Service providers meant to ensure adherence with the AUP and Third Party Service providers' equivalent usage policies, as applicable.
      • Attempting to obtain unauthorized access to computer systems and networks, or facilitating the disruption of critical infrastructure.
      • Intentionally deploying or using Output in violation of any third-party service terms or content guidelines applicable to the platform, its underlying technologies or the medium through which the Output is distributed or published;
    9. High-Risk and Regulated Uses
      • Using the Service or Output in ways that would be classified as “prohibited” or “high-risk” or by a similar description under applicable law, including applicable AI legislation and regulations;
  2. ENFORCEMENT AND COMMUNICATION

    Enforcement of the AUP, including the determination whether a violation occurred, is at Panjaya's sole and absolute discretion, and failure to enforce it in one instance does not constitute a waiver to enforce it in other instances. You will promptly cease use or remove any Customer Content violating the AUP, and Panjaya has the right to promptly remove or delete any violating Customer Content from the Service in its sole discretion.

    We encourage you to report any suspected abuse or misuse of the Service to Panjaya. If you believe your account has been incorrectly suspended, or your content has been incorrectly removed, you may contact Panjaya to request review.

  3. UPDATES TO THE AUP

    Panjaya may update this AUP from time to time. We will notify you of any significant changes in advance or as required by law. Changes will be effective on posting unless a later effective date is stated. Your continued use of the Service after the posting date constitutes acceptance of the updated AUP.
